The Board of Appeals of the Town of Tolland, MA met October 14, 2021 at Town Hall, beginning at 7:30 PM
Notice of Hearing as posted.
A petition from Jay and Paula Bertin of 15 Laurel Lane request approval for a variance to the 25 foot minimum setback from 25 feet to 9 feet to install a roof over concrete slab with enclosed screen over the slab patio and hot tub. The patio has existed since 2002. Area enclosed is 15 feet by 19 feet. Application 2021-4
A petition from Rene Brunet of 73 Lands End Dr. for a variance to the 25 foot setback to the side and 50 feet from the front to build a garage. The garage will be 22 X 24. Set back requested is for 18 feet in the front and 15 feet in the right side. Application 2021-3

Meeting began at 7:30PM Minutes of the Notes and meeting of July 29, 2021 were approved. Motion to accept petitions was made and unanimously approved.
Other business vote on making a change to our rules, copy attached. Section 2.3 Fees, sets the application fee at $350; this was never implemented and we are currently charging $225. I want to change the wording to; "Applications shall be accompanied by a filing fee to pay for the required advertising, mailing costs, Public Hearings, required transcripts, etc. The fee shall be set by the Selectmen and be posted on the Tolland Town Website, Board of Appeals section, Appeals and Variance page." By making this change, we can advise the Selectmen when we feel the fee should be changed
Meeting suspended and Public Hearing began at 7:38Rene Brunet 73 Lands End Dr. After presentation by Mr. Brunet, discussion was commenced led by neighbors and representatives of the Lands End Road Association (LERA) regarding property lines and the 50 foot right away owned by the LERA. Because the documents presented to the ZBA did not show the pin locations of the lot, David Spidal moved and Mike Sullivan seconded a motion to postpone a decision of the Appeal until Mr. Brunet retuns with appropriate documents indicating the location of the pins for the property line. Motion was approved unanimously Application 2021-3 continued
Jay Bertin of 15 Laurel Lane Application 2021-4 was approved unanimously after a discussion of the requirements for a variance. There was no opposition to the request since the brick patio existed since 2002 this request is not changing the footprint of the project.
Hearings ended and meeting resumed at 8:27.
Application 2021-4 approved unanimously.
