ORDER of BUSINESS:

Call to Order at 6 PM

Attendance – Mike Sullivan, Jen Zerra (remotely). Pat Storey; Visitor – Bob Mason MA DCR

Approval of Minutes -Feb. 9, 2021- Voting for Jen Zerra, Pat Storey; Abstaining Mike Sullivan

Acceptance of the following Petition for Zoning Variance:

A motion was made, seconded and unanimously approved to accept the application 2021-2; Kevin McCall, 74 Pinewood Dr. Tolland, MA 01034 to build a garage 2 ft. 7 in from his east side line

The meeting was temporarily adjourned and the Hearing convened at 6:05 PM

The meeting was reconvened at 6:10 PM.

The Board discussed application 2021-2

Public Comments – The only public comment was a letter supporting the application submitted by Anthony Krupa of 62 Pinewood Dr.

Action on application 2021-2 – After discussion, the Board found that:

1-The variance was with respect to a particular parcel of land or to an existing building on the land.

2-There were circumstances relating to the soil shape or topography especially affecting such land or building but not affecting the Zoning District in which it is located.

3-Literal enforcement of the ordinance would involve substantial hardship, financial or otherwise to the petitioner or applicant.

4-Desireable relief was granted since there will not be substantial detriment to the public good or nullification or substantial derogation from the intent of the Bylaw.

Since the requested Variance met the criteria for granting a variance a motion was made, seconded and unanimously approved to grant a variance allowing a 12 X 24 ft garage to be installed 2 ft. 7 in. from the east property line.

The proposed Notice of Decision was read, and the applicant advised that the Decision would be given to the Town Clerk. If there is no legal challenge to the decision, after twenty days after she will mail a copy of the Decision to the Applicant. The Applicant must file the decision with the Hampden County Register of deeds.
