MINUTES OF PLANNING BOARD
Meeting of 6/18/2007

A Public Hearing was opened by Chairman Joyce at 7:05 on an application for a special permit for a deck, on property of Chester Fisher at 185 Lands End Drive (Map 101, Lot 30).
o The 22’ x 16’ deck will encroach on the setback from the high water line which constitutes the back boundary of the property.
o As no one appeared to speak in opposition to the project, the Public Hearing was closed.
Regular Meeting opened by Chairman Joyce at 7:10.
o Minutes of the Meeting of 5/21/2007 were approved as written.
Chester Fisher’s Special Permit to add a 22’ by 16’ deck to his house at 185 Lands End Drive (Map 101, Lot 30), was approved unanimously.
The Board of Selectmen requested that the Planning Board approve the Town owned lot, behind Mr. Lodevico’s house (i.e. Map 116, Lot 10) as a legal building lot despite its lack of frontage on a public or private road.
o According to our Town Attorney, Massachusetts General Law 81L, Section C, page 185, makes it possible for the Planning Board to designate this lot as a building lot with a 15’ wide right-of-way.
o Gertrude McKay was asked to recuse herself from the discussion and vote as she lives in the Wildwood subdivision, in which this lot exists. Gertrude McKay recused herself from the discussion and vote on this matter.
o Motion was made and approved by three votes to designate this lot as a building lot.
Site Plan approval for a house, requested by John Devine of 17 East Otter Road, Map 118, Lot 17. The lot is pre-existing non-conforming. All set backs will be meet. Application approved unanimously.
The next meeting of the Planning Board is scheduled for July 16, 2007 at 7:00 p.m.
